چكيده
هوا سرمايهاي حياتي و مشترك است كه آلودگي آن امروزه بحراني جدي براي سلامت عمومي و اقتصاد جهاني، بهويژه در ايران، ايجاد كرده است. ايران در اين ميان موقعيتي دوگانه دارد؛ از يكسو بهعنوان كشوري آسيبپذير، قرباني توفانهاي گرد و غبار فرامرزي است و از سوي ديگر به واسطه انتشار آلايندههاي صنعتي و شهري، در قبال جامعه بينالمللي مسئوليت دارد. اين رساله با روش توصيفي–تحليلي و بررسي اسناد و رويههاي قضايي، به تبيين دقيق تعهدات حقوقي دولت ايران براي مهار آلودگي هوا پرداخته است. يافتههاي پژوهش نشان ميدهد كه رژيم حقوق بينالملل آلودگي هوا بر سه پايه اصل منع آسيب فرامرزي، توسعه پايدار و رهيافت حقوق بشري استوار است. اين قواعد از طريق منابعي همچون معاهدات، عرف، قطعنامهها و رويه قضايي جاري بوده و تعهداتي مانند مراقبت بايسته، ارزيابي اثرات زيستمحيطي و همكاري، ماهيتي عرفي و الزامآور براي تمامي دولتها دارند؛ لذا ايران مستقل از عضويت در معاهدات، ملزم به رعايت اين موازين است. تحليل وضعيت داخلي حاكي از آن است كه عليرغم وجود قوانين مترقي نظير قانون هواي پاك 1396، شكافي ميان متن قانون و اجرا به دليل تحريمها، كمبود فناوري و ضعف نظارت وجود دارد؛ با اين حال، محدوديتهاي اقتصادي رافع مسئوليت دولت نيست. نتيجه اينكه بحران آلودگي هوا ناشي از ضعف در مديريت راهبردي، ساختار نظارتي و اولويت بخشي اجرايي است. راهبرد برونرفت مستلزم اقدام در دو سطح است: در سطح بينالمللي، ديپلماسي جهت تدوين كنوانسيون منطقهاي براي غرب آسيا با تكيه بر اصل «مسئوليت مشترك اما متفاوت»؛ و در سطح داخلي، اصلاح تخصيص عوارض آلايندگي به نوسازي صنعتي و تقويت دادخواهي زيستمحيطي نهادهاي مدني.

Abstract
Air is a vital, common asset; however, today its pollution has evolved into one of the greatest health and environmental challenges globally and in Iran. This problem inflicts billions of dollars in economic damages and heavy casualties on the country annually. Since atmospheric pollution recognizes no geographic boundaries, the central issue of the present study is delineating the scope of states’ legal obligations in this regard. Iran occupies a dual position in this context: on the one hand, as a vulnerable country, it is a victim of transboundary sand and dust storms, and on the other hand, as an emission source of industrial and urban pollutants, it bears responsibility toward the international community. The fundamental research question is: What obligations do the rules and principles of international law place on the government of Iran to control air pollution? The objective of this dissertation is to analyze the normative system of international law, identify the precise conventional and customary obligations of the Islamic Republic of Iran toward air pollution control, and provide effective legal solutions. The research methodology is “descriptive-analytical,” which, through the library collection of documents, treaties, international jurisprudence, and municipal laws, conducts a legal analysis of the norms and reconciles them with Iran’s sovereign duties. The research findings demonstrate that the international legal regime of air pollution rests on three pillars: the principle of prevention of transboundary harm, sustainable development, and a human rights approach. These rules operate across five layers of sources: treaties, custom, resolutions, soft law, and judicial practice; in such a way that the obligation to exercise due diligence and procedural duties, such as environmental impact assessment, notification, and cooperation, possess a customary and general nature and are incumbent upon states even independently of membership in treaties. Iran’s obligations are also a combination of adherence to international instruments (such as the Vienna Convention and Montreal Protocol, Stockholm Convention, and Desertification Convention) and customary standards. In the domestic system, despite progressive legislation such as the Clean Air Law enacted in 2017, factors such as unilateral sanctions, lack of clean technology transfer, institutional conflict of interest, and weak enforcement mechanisms have created a gap between the law on the books and implementation; however, economic constraints do not exonerate the state from the principle of responsibility and the obligation of due diligence. The ultimate conclusion is that the air pollution crisis, before being a technical issue, is a problem in the sphere of legal governance. Accordingly, the exit strategy requires action at two levels: internationally, active diplomacy toward drafting a binding regional treaty for West Asia and utilizing the principle of common but differentiated responsibilities to demand clean technologies; and domestically, reforming the allocation of pollution duties toward industrial modernization, and strengthening the environmental litigation of civil society organizations.
