چكيده فارسي
پژوهش حاضر با هدف تبيين مباني فقهي-حقوقي و اجتماعي جرمانگاري رفتار زنان و تحليل جايگاه آنان در نظام قضايي ساساني تدوين شده است. با وجود اهميت نظام حقوقي ساساني در تاريخ حقوق ايران، تاكنون پژوهش تطبيقي جامعي درباره جرائم، گناهان و مجازاتهاي زنان بر پايه آموزههاي اوستايي و متون فقهي-حقوقي پهلوي انجام نشده است. اين پژوهش با استفاده از روشهاي كيفي و كمّي و تحليل تاريخي، ساختار حقوق كيفري زنان را در سه حوزه سياسي، اجتماعي و اقتصادي بررسي و براي ريشهيابي مباني حقوق ساساني، احكام متون پهلوي را با متون اوستايي و منابع حقوقي بهصورت تطبيقي تحليل ميكند. پژوهش در پي پاسخ به اين پرسش است كه مهمترين جرائم سياسي، اجتماعي و اقتصادي زنان در دوره ساساني چه بوده و بر چه مباني فقهي-حقوقي استوار بودهاند. بر همين اساس، فرض شده است كه برجستهترين جرائم سياسي زنان سوءقصد به جان شاهنشاه، جرائم اجتماعي ناشي از نقض خويشكاريهاي مادري و همسري و احكام طهارت و نجاست، و جرائم اقتصادي مرتبط با خاوندي، پاينداني و همپاينداني بوده است. يافتههاي پژوهش نشان ميدهد نظام حقوقي ساساني، متأثر از جهانبيني زردشتي، پيوندي استوار ميان گناه و جرم برقرار كرده و بسياري از تكاليف ديني را به قواعد الزامآور حقوقي تبديل كرده بود. در اين نظام، جرمانگاري رفتار زنان بيش از زيان اجتماعي، بر انطباق رفتار با نظم ديني و آييني استوار بود. بررسي متون نشان ميدهد مهمترين جرائم سياسي زنان شامل سوءقصد به جان شاهنشاه، شهبانويان، سپهسالاران، بزرگان مملكتي و نيز ارتداد بوده است. هرچند شواهد موجود عمدتاً به زنان خاندانهاي نژاده محدود ميشود. حقوق مالكيت، ضمانت و تعهدات مالي زنان، مسئوليتهاي حقوقي متناظري ايجاد ميكرد و نقض اين تعهدات منشأ جرائم اقتصادي بود. در حوزه اجتماعي و آييني نيز، به سبب تأكيد فقه زردشتي بر حفظ طهارت، زناني كه در شرايطي چون دشتان، سقط جنين يا تولد نوزاد مرده قرار ميگرفتند، با سختگيرانهترين احكام فقهي-حقوقي مواجه ميشدند. همچنين، نقض خويشكاريهاي مادري و همسري از مهمترين جرائم اجتماعي زنان به شمار ميرفت و با پيامدهاي حقوقي و ديني سنگيني همراه بود. بررسي سير تطور مقررات از متون اوستايي به متون پهلوي نيز از گسترش نهادهاي حقوقي، توسعه آيين دادرسي كيفري و مدني و افزايش نقش روحانيت در تفسير و اجراي قواعد حقوقي حكايت دارد. در مجموع، نتايج پژوهش نشان ميدهد حقوق كيفري ساساني حاصل تعامل دين، قدرت سياسي و نظم اجتماعي بوده و بازسازي نظاممند جرائم و مجازاتهاي زنان بر پايه متون اصيل پهلوي، تصويري منسجم از جايگاه زنان و سازوكار جرمانگاري در حقوق ايران پيش از اسلام ارائه ميدهد.

This dissertation investigates the theological, legal, and social foundations of the criminalization of women’s conduct and their legal status within the Sasanian judicial system (224–651 CE). Despite the significance of Sasanian law in the history of Iranian legal institutions, no comprehensive comparative study has systematically examined women’s sins, crimes, and punishments through the combined analysis of Avestan teachings and Middle Persian legal texts. Employing the historical-analytical method, this study reconstructs the structure of women’s criminal law in the political, social, and economic spheres and traces the development of Sasanian legal principles through a comparative examination of Avestan and Middle Persian sources. It addresses the question of the principal political, social, and economic crimes attributed to women in the Sasanian period and the theological and legal foundations upon which they were constructed. It further hypothesizes that the principal political offense was attempted assassination of the King of Kings; the principal social offenses involved violations of maternal and marital obligations and ritual purity regulations; and the principal economic offenses concerned khwāndī, pāyandānī, and ham-pāyandānī.
The findings demonstrate that the Sasanian legal system, shaped by the Zoroastrian worldview, established a close relationship between sin and crime by transforming religious obligations into enforceable legal norms. The criminalization of women’s conduct depended primarily upon conformity to the religious and ritual order rather than the concept of social harm. The evidence indicates that the principal political offenses included attempted assassination of the King of Kings, queens, military commanders, high-ranking officials, and apostasy, although the extant evidence relates predominantly to aristocratic women. Womenʹs rights to property, suretyship, and financial obligations entailed corresponding legal responsibilities, the violation of which constituted economic offenses. In the social and ritual sphere, regulations governing menstruation, miscarriage, stillbirth, and violations of maternal and marital obligations carried the severest legal and religious sanctions. The transition from the Avestan corpus to the Middle Persian texts likewise reflects the development of legal institutions, the expansion of civil and criminal procedure, and the increasing authority of the Zoroastrian priesthood in legal interpretation and enforcement. Overall, the study demonstrates that Sasanian criminal law was shaped by the interaction of religion, political authority, and social order. By reconstructing women’s crimes and punishments on the basis of authentic Middle Persian sources, it provides a more coherent understanding of women’s legal status and the mechanisms of criminalization in pre-Islamic Iran.
