Abstract
Marriage is a contract that, in addition to the duties it imposes on the couple, also creates rights for them. These rights are both financial and non-financial. Most non-financial rights in marriage are reserved for the husband and financial rights are mostly reserved for the wife; For this reason, the explanation of the non-financial rights of the wife in different legal systems has always been the subject of discussion. Especially in the Persian Gulf countries, which have recently been considered by lawmakers based on social pressures, attention to the customary and legal rights of women.
It has been determined that according to this thesis, comparative study of the financial and non-financial rights of couples in the laws of Iran and Bahrain with descriptive and analytical methods and library sources, that the study of protection institutions in the mentioned countries shows the closeness of rights. The financial and non-financial rights of women in these countries include the fact that the financial rights of the wife include such things as customary wages, alimony, and dowry, which are supported with little difference in these countries. There are rights such as the right to housing, the right to visit a child, etc., some of which are reflected in jurisprudential standards and are not mentioned in legal texts, and of course some are specific to permanent marriage, some are specific to temporary marriage, and some are specific to temporary marriage. It is also common between them, but non-financial rights in Bahrain according to the time
periods before marriage. They are divided during and after the dissolution of
the marriage which can be checked in different parts.
In any case, the results of this research show that in Iranianʹs legal system, in order to explain the examples of the wifeʹs non-financial rights, the legislator interfered less in the private affairs of the family and left the management of these affairs to the spouses, and often these matters in terms of execution to the system while the Bahraini legislature, in addition to the time division of the financial and non-financial rights of the wife (before the conclusion of the contract, during the marriage, termination of the marriage) in more detailed cases, has also included the non-financial rights of the wife has explained more clearly.
