توليد و قاچاق مواد مخدر در افغانستان و ترانزيت آن از جغرافيايي جمهوري اسلامي ايران، داراي آثار و پيامدهايي زيانباري براي اين كشورها علي‌الخصوص جمهوري اسلامي ايران است. همسايگي ايران با افغانستان، همچنين قرار گرفتن ايران در مسير اصلي قاچاق مواد مخدر، امنيت مناطق مرزي را به‌طور خاص و امنيت هر دو كشور را به‌طور عام از چشم‌انداز سياسي، امنيتي، اقتصادي، اجتماعي و فرهنگي مورد تهديد جدي قرار داده است. قاچاق مواد مخدر، قاچاق انسان و افزايش درگيري‌هاي مرزي و ناامني‌هاي مرزي، پيامدهاي منفي بي‌شماري را متوجه اين دو كشورها نموده است. اين پژوهش مي‌كوشد با روش توصيفي - تحليلي ضمن تبيين مواد قانوني در خصوص قاچاق مواد مخدر در نظام حقوقي دو كشور ايران و افغانستان به بررسي تطبيقي جرم قاچاق مواد مخدر در كشورهاي افغانستان و ايران نيز بپردازد. يافته‌هاي اين تحقيق نشان مي‌دهد كه حقوق كيفري ايران نسبت به حقوق كيفري افغانستان در قبال مواد مخدر ظاهراً مجازات سركوبگرانه و سخت‌تري را در نظر گرفته است. همچنين مبناي جرم انگاري قاچاق مواد مخدر در كشور افغانستان و ايران به ملاحظات حقوقي و اجرايي قانون‌گذار آن كشور بستگي دارد.

Investigation of the crime of Drug trafficking in Iran and Afghanistan law

The production and trafficking of drugs in Afghanistan has harmful effects and consequences for the neighbors of this country, especially the Islamic Republic of Iran. Iranʹs neighborhood with Afghanistan, as well as Iranʹs location on the main route of drug trafficking, the security of Sharaf border areas in particular and the security of both countries in general from the political, security, economic, and social perspective. And culture has been seriously threatened. Drug trafficking, human trafficking and the increase in border conflicts and border insecurity have caused countless negative consequences for these two countries. This research tries to do a comparative analysis of the crime of drug trafficking in Afghanistan and Iran by explaining the legal provisions regarding drug trafficking in the legal system of Iran and Afghanistan with a descriptive-analytical method. The findings of this research show, Iranʹs criminal policy seems to be more repressive and harsh compared to Afghanistanʹs criminal policy regarding drugs. Also, the basis of criminalization of drug trafficking in Afghanistan and Iran depends on the legal and executive considerations of the legislator of that country.
