In recent decades, the judiciary has consistently faced the challenge of increasing case loads in courts. This factor has led to public dissatisfaction and a decline in the quality of judicial performance, along with negative consequences. After analyzing the input and output statistics of cases and the number of registered lawsuits that faced an unreasonable delay in their scheduled hearing dates, significant figures of pending litigation in civil and criminal branches prompted the judiciary to seek solutions to this ongoing issue. Article 187 of the Third Development Plan Law, approved with the aim of "providing necessary legal protections and facilitating peopleʹs access to judicial services and preserving public rights," included measures in this regard on its agenda. However, in the implementation of the mentioned support measures, the necessary infrastructure has not been provided, and the problem persists even after two decades since the lawʹs approval. In this research, using the descriptive analytical method and according to the topic of the research, the library method was used to collect the research literature and the legal solutions to reduce the lawsuits were analyzed.
In this research, with the aim of investigating the causes of the density of lawsuits (such as problematic laws that produce lawsuits, delaying proceedings, the performance of persons such as judges, lawyers, employees and experts, people in creating disputes and the emergence of lawsuits) and after that, presenting legal solutions to reduce Lawsuits with an emphasis on the required reforms of formal laws and changes in the performance of the named persons, as well as changes in the current judicial structure along with the introduction of alternative methods of settling lawsuits and using the method of judgment during the time of Imam Ali (AS), when both speed and accurancy in judicial proceedings were pursued for realization of justice among peaole, an effort was made to reduce the increase or the speed of the production of lawsuits by presenting appropriate proposals.
